1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the EveryTradePro platform, including all associated websites, applications, platforms and services, including EveryInstall and any related services (collectively referred to as the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

3. Eligibility

To use the Platform, you must be at least 16 years of age.

By creating an account, you confirm that:

The information you provide is accurate, complete and up to date;
You have the legal capacity and authority to enter into this agreement;
You will comply with these Terms at all times.

4. Accounts and Membership

Free Membership

Users may register for a free account, which provides limited access to selected content, resources and features.

Paid Membership

Paid subscriptions provide enhanced access to content, downloads, training materials and additional features.

By purchasing a subscription, you acknowledge and agree that:

Subscription fees are charged on a recurring basis unless cancelled;
You are responsible for managing and cancelling your subscription if you no longer wish to continue;
We reserve the right to modify, add or remove membership features, benefits or pricing at any time.

Any changes to subscription pricing will be communicated in advance where required by applicable law.

5. Payments and Refunds

Payments are processed securely through third-party payment providers.

By making a payment, you also agree to comply with the applicable terms and conditions of the relevant payment provider.

Unless otherwise required by law:

Fees paid are non-refundable;
Refund requests will be considered on a case-by-case basis at our sole discretion;
We are under no obligation to provide a refund where access to paid content or services has been provided.

Nothing in these Terms affects your statutory consumer rights.

6. Use of Content

All content made available through the Platform, including training materials, downloads, videos, documents and resources, is provided for your personal and non-commercial use only.

You must not:

Copy, reproduce or distribute any content without prior written permission;
Share, sell, transfer or otherwise provide access to your account or login credentials to any third party;
Use any content for commercial purposes without our express written consent;
Modify, republish or create derivative works based on Platform content.

7. Intellectual Property

All intellectual property rights in the Platform, including its content, branding, trademarks, software, systems and materials, are owned by or licensed to Every Trade Pro Limited.

Subject to these Terms, you are granted a limited, non-exclusive, non-transferable and revocable licence to access and use the Platform for personal use only.

No ownership rights are transferred to you.

8. User Conduct

You agree not to:

Use the Platform in any unlawful, fraudulent or harmful manner;
Attempt to gain unauthorised access to any part of the Platform, systems or networks;
Interfere with, disrupt or damage the operation or security of the Platform;
Upload, transmit or distribute any harmful code, malware or malicious content;
Use the Platform or its content in a misleading, defamatory or unlawful manner.

9. Third-Party Services

The Platform may integrate with or utilise third-party services, including payment processors, analytics providers and other external tools.

We are not responsible for:

The availability or performance of third-party services;
The content, policies or practices of third-party providers;
Any loss, damage or issues arising from your use of third-party services.

Your use of such services is governed by the relevant third party’s terms and policies.

10. User Content and Media Rights

From time to time, users may submit content, recordings, photographs, videos, testimonials or other materials (“User Content”).

By submitting User Content, you grant Every Trade Pro Limited a worldwide, non-exclusive, royalty-free, perpetual and irrevocable licence to use, reproduce, publish, distribute, display, modify and promote such content across our websites, platforms, social media channels and marketing materials.

You confirm that you have the necessary rights and permissions to submit such content.

11. Disclaimer and Limitation of Liability

The Platform and all content are provided on an “as is” and “as available” basis.

We make no representations or warranties regarding:

The continuous availability of the Platform;
The accuracy, reliability or completeness of any content;
The suitability of the Platform for any particular purpose.

To the fullest extent permitted by law, Every Trade Pro Limited shall not be liable for:

Loss of profits, revenue, business opportunities or anticipated savings;
Business interruption;
Loss of data;
Indirect, incidental, special or consequential losses or damages.

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful.

12. Suspension and Termination

We reserve the right, at our sole discretion, to suspend, restrict or terminate your account and access to the Platform at any time, with or without notice, particularly where we reasonably believe that you have breached these Terms.

Termination does not affect any rights or obligations accrued prior to termination.

13. Changes to These Terms

We may amend these Terms from time to time.

Any updated version will be published on the Platform and will become effective upon publication unless otherwise stated.

Your continued use of the Platform following any changes constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

Any dispute arising out of or relating to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
